Who is Entitled to Italian Citizenship?
Law 74/2025 brought profound changes to the recognition of Italian citizenship by descent (jus sanguinis). See the main points:
Residency in Italy Required for Minor Children
- Now, the minor must reside for at least 2 years on Italian territory to be entitled to citizenship recognition.
Generational Limit
- Transmission by descent is now restricted to children and grandchildren of Italian nationals born in Italy.
Exclusivity of Citizenship
- It is now necessary to prove that the ancestor maintained only Italian citizenship, without naturalization in another country, in order to transmit nationality.
Limitation of Jus Sanguinis
- Administrative recognition is only permitted up to the grandchildren's generation. For descendants beyond this generation (great-grandchildren onwards), the only possible route is judicial action.
Cases Preserved by the Law
- Processes already filed before March 27, 2025 remain valid.
- Parents and grandparents born in Italy still transmit citizenship to their children and grandchildren.
- Parents legally residing in Italy for more than 2 years after their own citizenship recognition and before the child's birth can transmit it.
- Until May 31, 2026, there is a transition period for declarations of minor children born before the law or within their first year of age.
